NBA Ungogo decries killing of 16 northern travelers, demands justice

The Nigerian Bar Association (NBA), Ungogo Branch, has strongly condemned the killing of 16 northern travelers in Edo State, describing the act as a gross violation of human rights.  

In a statement issued on Monday, the chairman of the branch, Ahmad A. Gwadabe, expressed deep concern over the tragic incident, calling it “gruesome and unacceptable.”  

“We are appalled and deeply disturbed by the murder of innocent travelers who were simply passing through the state. This act goes against the principles of humanity and decency,” Gwadabe stated.  

He called on the Edo State Government and security agencies to swiftly investigate the matter and ensure the perpetrators are brought to justice. 

“We demand immediate and decisive action to hold those responsible accountable,” he added.  

The association also urged the government to provide compensation to the families of the victims and implement measures to prevent similar occurrences in the future.  

“As lawyers, we are committed to upholding the rule of law and promoting justice for all citizens, regardless of their ethnicity, religion, or place of origin,” Gwadabe emphasized.  

The statement concluded with a call for calm, urging the affected families to remain law-abiding while seeking justice.

Akpata joins Labour Party

Immediate past national President of the Nigerian Bar Association (NBA), Olumide Akpata, has confirmed joining the Labour Party. 

Akpata on Monday disclosed that he has been a member of the Labour Party since March 2023.

According to Mr Akpata, he deemed it necessary to put the speculations that he has joined partisan politics to rest and hence the announcement. 

“Quite a number of people have called/messaged me to confirm the news, currently making the rounds, that I have joined a political party. Yes…I joined the @labourparty_ng in March this year, and on Sunday, I attended my first Ward Meeting at Oredo Ward 6, in Benin-City, where I was formally introduced to members of the Ward and presented with my Party membership card. This was a major step for me and not one that I took lightly…but I simply got tired of complaining about Nigeria every day and bemoaning her fate, and I decided to take the plunge and to try to be part of the solution rather than agonising continually over the problem. This, for me, is the start of a very important journey, and it is my prayer that I arrive safely at my destination.” He posted on Facebook.

LPPC calls for applications for the award of SAN

The Legal Practitioners’ Privileges Committee (LPPC), has requested that legal practitioners in Nigeria, who desire the attainment of the rank of Senior Advocate of Nigeria (SAN), should submit applications online.

This was disclosed by the Chief Registrar of the Supreme Court and Secretary of the Legal Practitioners’ Privileges Committee, Hajo Sarki Bello in a memoir on Monday, January 2, 2022.

Bello said this year application is online and lawyers who desire the award of the rank of SAN should submit relevant documents to the LPPC’s portal.

He added that all applicants must pay a non-refundable processing fee of one million naira and upload evidence of the payment online.

Part of the memoir reads: “By the combined provisions of Section 5(2) of the Legal Practitioners’ Act Cap 11 Laws of the Federation of Nigeria of Nigeria 2004 and the Regulation 10 (1) – (4) of the Guidelines for the Conferment of the Rank of Senior Advocate of Nigeria 2022. (“The Guidelines”) the Legal Practitioners’Privileges Committee ( “the LPPC or the Committee “) hereby makes a formal call for applications preparatory to the rank of the year 2023. Commencing with the year’s exercise applications shall only be made online and prospective applicants are directed to visit www. lppconline.com to make their application.”

The rank of Senior Advocates of Nigeria is the highest rank in the Nigerian Bar. It is the equivalent of the rank of the Queen’s Counsel in the United Kingdom. The rank of SAN is yearly awarded to legal practitioners that have distinguished themselves in character and advocacy.

Policeman murders female lawyer on Christmas day

A female lawyer identified as Bolanle Raheem has been allegedly killed by personnel of the Nigerian Police Force (NPF) 

Mrs Raheem was shot dead by an unknown policeman while on his way from Christmas Church Service on Sunday. She was pronounced dead upon arrival in the hospital she was rushed to.

The Spokesperson of the Lagos State Police, SP Benjamin Hundeyin, has confirmed the incident in a statement he issued on behalf of the NPF.  

Hundeyin described the incident as “unfortunate and avoidable”. He stressed that justice will prevail” 

“The Lagos State Police Command condoles with the family, friends and colleagues of Barrister Bolanle Raheem. The Commissioner of Police, Lagos State Command, CP Abiodun Alabi, has been in touch with the family and the Nigerian Bar Association since yesterday and has given firm assurances that justice will definitely prevail.” He tweeted

Meanwhile, the Nigerian Bar Association ( NBA) has demanded that justice should be served in the matter. 

NBA National Publicity Secretary Akorede Lawal wrote, “We are aware of this unfortunate incident. This is yet another crime against a lawyer. Regrettably, our member is gone…We shall ensure that justice is duly served.”

Council of Legal Education releases result of Bar Finals

The Council of Legal Education, CLE, has released the 2022 Bar ll examination results.

The results of the Bar finals were released by the council in the early hours of Thursday. Students of the Nigerian Law School who spoke to The Daily Reality confirmed that they have checked their results.

The NigeriaLawyer reports that 119 students representing 2.05% bagged first class, 787 representing 13.56%, and 2460 representing 42.40% secured Second Class Upper and Lower divisions respectively. Also, 1323 students constituting 22.8% made a pass, while the conditional pass category had 185 students making 3.19%.

For a person to be qualified to practice as a legal practitioner in Nigeria, he is required to be enrolled at the Nigerian Law School and Pass the Bar Finals.

NBA Vice President faults Tinubu’s absence at conference

John Aikpokpo-Martins, the Vice President 1 of the Nigerian Bar Association (NBA), has faulted the absence of the All Progressives Congress (APC) presidential candidate, Bola Ahmad Tinubu, at the NBA 2022 Conference. 

In a post made on Facebook on Monday, the senior lawyer said, “The failure of Tinubu to be at the NBA conversation is a bold statement.” 

Senator Kashim Shettima, the vice-presidential candidate of APC, represented Tinubu at the NBA 2022 Conference themed “Bold Transition”.

In attendance at the conference were leading presidential candidates for the 2023 election. These include former Nigeria’s vice president and presidential candidate of the Peoples Democratic Party, Alhaji Atiku Abubakar and presidential candidate of the Labour Party, Mr Peter Obi and other dignitaries.

It is an “S-A-N” not a “SAN”

A few days ago, after witnessing the interment of a late Senior Advocate of Nigeria (SAN), I made a grieving post on my social media handles as follows:

“It looks beautiful to witness the admission of an SAN into the inner bar; and it is so direful to witness the laying of a late SAN into the inner earth. The name, the prestige, gone! Bottom line is to watch the end as we watch the goal.”

I received several direct messages seeking to correct my perceived grammatical error in using the indefinite article “an” to “SAN” in the first line of the above post. But in the true sense, there is no error in it, based on the popular usage of the term within the legal circle in Nigeria. An average lawyer uses the term as an abbreviation like “etc” not as an acronym such as NATO or CITAD. So forgive us for not using the dots like “S.A.N.”, which is typical of some abbreviations.

Therefore, an average lawyer pronounces the term to sound like “es-ey-en” and not sound like “-san” as in “Sani”, “san yoghurt”, or “San Francisco”. The contrary is the usual way of pronouncing the term by an average non-lawyer in Nigeria.

It is known that “a” as an indefinite article is attached to a word whose pronunciation starts with a consonant sound, while “an” is attached to a word which starts with a vowel sound. Therefore, since an indefinite article is attached to a word based on the sound of its preceding letter(s) of the alphabet, such as saying “an hour” or “a unanimous”, I believe a lawyer will be correct to say “an SAN”( es-ey-en).

I also said “a late SAN” in my post quoted above. However, I think that is not an issue because the article “a” serves the adjective “late” and not the SAN that succeeded it.

I am not a grammarian, but I hope this little explanation explains the tradition, most especially to people outside the bar.

I can’t imagine how funny it will sound after one works day and night to achieve the silk and a colleague look at him in the eye and call him “-san”.

I sincerely appreciate the efforts of those who attempted to correct my mistakes, and I will always welcome the same at any time. Thank you so much.

NBA in crisis, suspends General Secretary

The Nigerian Bar Association (NBA) has suspended its General Secretary, Joyce Oduah, over what it called “gross misconduct”.

This is coming after an emergency meeting of the National Executive Committee (NEC) of the association held on Monday, August 15, 2022.

The NEC meeting was presided by the 1st Vice President of the association, Mr John Aikpokpo-Martins, after the president , Mr Olumide AKpata, had voluntarily withdrawn from the meeting.

The major allegation levelled against Mrs Oduah was her solitary withdrawal of notices for the amendment of the NBA constitution, an action which has thrown the members of the association into pandemonium.

Troubles started for Mrs Oduah on Friday when the NBA President, Mr AKpata, issued a disclaimer annulling the withdrawal of the notices for the NBA constitution amendment .

NBADECIDES2022: The cries; and the fruits of conceding defeat

Like any other election, the NBA Elections, 2022 has come and gone with winners and runner-ups (not losers). But, of course, not without some cries.

In every contest, it is incumbent that one contestant must be the victor, and the other will lose that opportunity to be in the winner’s position. It is painful to lose in a sports competition, literally being a contest for gold, silver, and bronze. Hence, the word “sportsmanship” explains the endurance required of a loser in a sports competition.

However, it is different when it comes to a leadership contest in which a person who believes in his capacity to serve certain people or organizations presents himself for election. On the one hand, their election ought to be defined as a win for the organization that now has a servant. But, on the other hand, defeating his co-contestants ought to be described as a relief for those contestants from the burden of service.

Defeat in an election is another opportunity for a defeated contestant to rethink his manifesto and plans for his constituents if he genuinely means service to them. It is also an opportunity to rebuild their personal relationship with voters.

A candidate in an election is presumed to have vied for that office out of love for his constituents. This, therefore, presupposes that the said candidate respects those he is presumed to love and their choices because the election itself determines the choice of those constituents.

An election is not a do-or-die affair. Any candidate who takes it otherwise and creates animosity before or after an election will never make a good leader. This is a religious injunction in my faith of Islam. I have seen similar biblical rulings like Proverbs 28:25, which states: “The greedy stir up conflict, but those who trust in the Lord will prosper.”

NBADECIDES2022 was an election for the leadership of the noblest profession in Nigeria. But, unfortunately, within less than 24 hours of the conduct/declaration of the results, several, apparently sponsored, persons or those crying more than the bereaved were seen maligning the candidates-elect and the ECNBA, the electoral umpire.

Having said the above, conceding an apparent defeat in an election by a candidate does not depict the candidate as weak. On the contrary, it simply presents the candidate as a hero who meant his words by respecting the choice of the people he sought to lead. The example of former President Jonathan is not far away, and the sad contrary situation could be seen in Ivory Coast.

In short, the fruit of conceding an apparent defeat may provide several opportunities and consideration to a runner-up candidate over and above what his election would have otherwise provided.

Maikyau wins NBA presidential election

Yakubu Chonoko Maikyau, SAN, has emerged winner in the presidential election of the Nigerian Bar Association, NBA.

The Electoral Committee of the Nigerian Bar Association, ECNBA, conducted an electronic election on Saturday, June 16, 2022, to elect the association’s president and 10 other national executives. 

Maikyau, SAN, polled 22342 in the election to defeat his closest rival, JK Gadzama SAN, who polled 10842.

Maikyau was born on February 6, 1965. He obtained a Bachelor of Laws (LLB) Degree from the Ahmadu Bello University, Zaria, Kaduna State, in 1989, then attended the Nigerian Law School, Lagos Campus and was called to the Nigerian Bar on December 12, 1990.

Maikyau would be succeeding Olumide AKpata as the 36th president of the NBA.
